Protesting Property Taxes in New Braunfels and Canyon Lake

Comal County is growing from two directions: commercial development and suburbs along I-35, and vacation and rental property around the lake and rivers.

Commercial growth in New Braunfels.

Retail, industrial, and new commercial buildings along I-35. A new building still in lease-up, or one valued as if it were fully leased, is a common protest point. So are new homes partially complete on January 1 and builder sales that include incentives.

Short-term rentals.

Canyon Lake and the Guadalupe and Comal rivers draw a large short-term rental market. A short-term rental is still appraised as real estate, and strong nightly revenue doesn’t make the house worth more. Value comes from what comparable homes sell for. Districts are also opening business personal property accounts on furnished rentals. We handle both.

Hill Country acreage.

Bulverde, Spring Branch, and the western part of the county have custom homes and larger tracts. Cost-based values for rural improvements often carry the wrong quality grade or too little depreciation.

Second homes.

No homestead exemption and no 10% cap, so the full increase lands every year.

Comal is a smaller district with a small review board. Custom homes on acreage don’t fit a standard model, so more of our Comal cases go to a formal hearing than in most counties. The Comal County Property Tax Protest Process

Every protest follows the same path. Here is how it runs with the Comal Appraisal District.

Read your notice.

The Comal Appraisal District values your property as of January 1 and mails notices of appraised value in the spring. The notice shows the value you’re protesting and your deadline.

File by the deadline.

May 15, or 30 days after the notice is mailed, whichever is later. A protest filed on time keeps every later option open.

Get the district’s evidence.

You’re entitled to see the evidence the district will use before your hearing. It shows how the district reached its number and where to challenge it.

Meet with the district’s appraiser.

Most protests start with an informal meeting with a Comal Appraisal District appraiser. Many settle here.

Go before the Comal Appraisal Review Board.

If the informal meeting doesn’t resolve it, a panel of local residents hears the protest and issues a written order.

Appeal further if needed.

Within 60 days of receiving the order, you can request binding arbitration or file suit in district court.
